This Privacy Policy explains how Tres-POS ("TresPOS", "we", "us"), provided by My3Solutions, collects, uses and protects information when restaurants ("Merchants") and their staff use the Tres-POS point-of-sale system and its payment integrations.
1. Who this policy covers
Tres-POS is business software. Our direct users are Merchants and their employees (servers, cashiers, kitchen staff and managers). Guests of a Merchant do not use Tres-POS directly, but some information about their orders and payments is processed on the Merchant's behalf.
2. Information we process
- Merchant and staff account information: names, usernames, login PINs and passwords, roles, email addresses and time-clock records entered by the Merchant.
- Order information: tables, menu items, notes, totals, taxes, tips and discounts, and customer names or phone numbers if the Merchant chooses to enter them for to-go or delivery orders.
- Payment results: when a card payment is taken, we receive and store the result from the payment processor: amount, tip, surcharge, approval status, card brand, the last four digits of the card, authorization code and the processor's payment ID.
- Payment account connection information: when a Merchant connects Tres-POS to a payment provider, we receive the Merchant's account ID and name with that provider, and access tokens that let Tres-POS send payment requests to the Merchant's card terminals.
- Technical information: standard server logs (IP address, browser type, pages requested, errors) used to operate and secure the system.
3. Card data
Tres-POS never receives, stores or transmits full card numbers, expiration dates, CVV codes or PINs. Cards are tapped, dipped or swiped directly on the payment terminal, and card data is handled by the payment processor. Tres-POS only receives the payment result described above.
4. How we use information
- To run the Merchant's restaurant operations: taking orders, routing tickets to kitchen displays and printers, managing tables, processing payments and closing checks.
- To record tips and payments for staff payouts, reporting and end-of-day reconciliation.
- To void or refund a payment when the Merchant requests it.
- To provide support, fix problems and keep the system secure.
We do not sell personal information, and we do not use Merchant or guest data for advertising.
5. Where information is stored
Tres-POS runs on a server operated by or for the Merchant. Order, staff and payment-result data is stored in the Merchant's Tres-POS database on that server. Payment provider access tokens are stored on the same server and are used only to communicate with the Merchant's own payment account and terminals.
6. Sharing
We share information only as needed to provide the service:
- Payment processors, to process payments the Merchant initiates.
- Service providers who help us host or support the system, under confidentiality obligations.
- Legal requirements: when required by law or subpoena, or to protect rights and safety.
7. Security
We use reasonable safeguards, including encrypted (HTTPS/TLS) connections to payment processors, encrypted storage of configuration secrets, and role-based access for staff. No system is perfectly secure, and Merchants are responsible for securing their own server, network and devices.
8. Retention
Order and payment records are kept for as long as the Merchant uses Tres-POS, or as needed for accounting, tax and legal obligations. When a Merchant disconnects Tres-POS from a payment provider or revokes its access, Tres-POS can no longer access that account, and we will delete the stored access tokens on request.
9. Merchant and individual choices
Merchants can view, correct or delete staff and order information in Tres-POS, and can revoke Tres-POS's access to their payment account at any time from that provider's dashboard. Individuals who want to access or delete information about them should contact the restaurant, which controls that data; we will help the Merchant respond.
10. Children
Tres-POS is not directed to children under 13, and we do not knowingly collect their information.
11. Changes
We may update this policy. The "Last updated" date above shows when it last changed. Material changes will be communicated to Merchants.
